Agent Terms
Version agent-terms-v1 · Effective 27 October 2026
Last updated: 27 October 2026
These are the terms for using StudyInSG as an education agent. They set out the standards we expect when you look after students, and what you can expect from us. Please read them carefully before you create an account.
1. Eligibility and approval
1.1You may use the full Platform as an Agent only after we have approved you. You must be an adult and either be a registered education agency or counseling business, or work for one with its authority.
1.2As part of approval we may ask for business registration details, licenses, references, identity checks and details of the people who will use the Platform. We may refuse approval, attach conditions to it, or later withdraw it, at our reasonable discretion, and we will give reasons where it is reasonable and lawful to do so.
1.3Approval is personal to your agency. You may not transfer it, share it, or let another business use your Account. You must tell us promptly if your registration, ownership, licenses or key people change, or if you become subject to any investigation, ban or finding that relates to education agent work.
1.4Until you are approved, you may not place Applications through the Platform and you may not tell anyone that you are an approved StudyInSG Agent.
2. Agent obligations
2.1You must recruit and advise Students lawfully, honestly and fairly, and in line with the laws of Singapore, the laws of any country in which you operate, and any code of conduct or licensing rule that applies to education agents.
2.2You must verify each Student's identity and genuine intention to study before you place an Application, and you must collect and check the Application Documents. You must not submit a document that you know, or ought reasonably to suspect, is false or altered.
2.3You must give each Student accurate and current information about entry and visa requirements, fees, deposits, refund policies and refund processes, the Application process and realistic timelines. If you do not know an answer, you must say so rather than guess. You must make sure that each Student understands that fees and refunds are set by the Institution and not by you or by StudyInSG.
2.4You must tell each Student, before the Student decides, about any Commission or other benefit that you will receive in connection with the Student's Application, and you must keep a record that you did so.
2.5You must never promise or imply that admission, a scholarship or a visa is guaranteed. You must not advertise in a way that is false, misleading or exaggerated, and you must not use the StudyInSG name or logo in advertising without our written permission.
2.6You must not impersonate any person, and you must not claim to be StudyInSG, an employee of StudyInSG, an Institution or an employee of an Institution unless that is true.
2.7You must keep full and accurate records of your work with each Student, including how the Student was advised, what Consent was given, and what was said about fees and Commission. You must keep these records for as long as the law and our written agreement with you require and give us copies when we reasonably ask.
2.8You must keep Students' Personal Data confidential, use it only for the Student's Application and related support, and protect it with reasonable security. You must not copy it to unsafe places, share it with people who do not need it, or use it for marketing without the Student's separate Consent.
2.9You must notify us promptly, and in any case within the time stated in our written agreement with you or, if none is stated, within two working days, of each of the following:
- a Student withdrawing or changing Consent;
- a data breach or suspected data breach affecting Personal Data from the Platform;
- the outcome of a Student's visa or student pass application, where you know it; and
- a Student's enrollment, deferral, withdrawal or failure to enroll.
2.10Where we ask for it, you must upload evidence of Consent, such as a signed form or a record of a parent's or guardian's involvement for a Student under 18. You must not upload evidence that you know to be false.
2.11For a Student under 18, you must involve a parent or legal guardian in the Application and in the giving of Consent, as the law and the Institution require. You may not sign up a Student under 18 yourself without that involvement.
2.12You must cooperate with any audit, review or enquiry that we carry out in good faith, including by giving us access to relevant records and by answering questions truthfully and on time.
2.13You are responsible for the staff who use the Platform under your agency. You must make sure each of them has a separate Login, knows these Terms, is properly supervised and acts lawfully. Their acts and omissions are treated as yours.
2.14You must not appoint or use sub-agents, or let any third party place Applications through your Account, without our prior written permission.
2.15Unless our written agreement with you says otherwise, you must not deal with an Institution outside the Platform in order to avoid the Platform on an Application that was placed through it.
3. Commission and fees
3.1Fees payable to StudyInSG and any Commission are set out in a separate written agreement between StudyInSG and you, or in the Platform where it says so. [Commission and fee terms are set out in your written agreement with StudyInSG; to be confirmed]
3.2We do not set tuition fees, application fees, deposits or any other fee that an Institution charges. Those fees are decided by the Institution and may change. You must pass on accurate information about them and must not add to them in a way that the Student has not been told about.
3.3You must tell each Student about any fee that you charge the Student, and about any Commission you receive, before the Student is asked to pay or decide. You must not collect money from a Student for a purpose that you have not explained, and you must give a receipt for money you collect.
3.4Whether a payment made to an Institution can be refunded, and on what conditions, is decided by the Institution's rules and by the law that applies. StudyInSG is not responsible for refunding an amount that an Institution holds. You must explain the refund position to the Student honestly and must handle any refund that you are responsible for promptly and in line with the law.
3.5Unless a separate written agreement says otherwise, all amounts are stated in the currency shown, are payable by the due date, and are exclusive of any applicable goods and services tax or other tax, which is added where it applies.
4. Conduct that is not allowed for Agents
4.1In addition to the rules on acceptable use in these Terms, you must not do any of the following:
- place an Application for a person who has not agreed to it, or in a name that is not the person's own;
- tick, sign or record Consent for an adult Student, or for anyone else, in that person's place;
- submit, alter, create or hide a document in order to make an Application look stronger or to get around an Institution's rules;
- pressure, threaten or mislead a Student, including by creating false urgency or by saying that StudyInSG or an Institution requires something that it does not;
- take payment from a Student for a place, a visa or an outcome that you have no power to deliver;
- share your Login, or let a person who is not a named user of your agency place Applications or see Students' data;
- contact a Student outside the Platform in order to avoid the contact rules for messages about an Application on the Platform; or
- use Students' Personal Data to market other products or services, or pass it to anyone who does not need it for the Application, without the Student's separate Consent.
4.2If we reasonably believe that you have broken this clause, we may suspend or close your Account, withhold or reverse any amount that we are allowed to under our written agreement with you, tell the Institutions and Students affected, and report the matter to the relevant authorities.
5. About StudyInSG and these Terms
5.1These Terms are a legal agreement between you and StudyInSG. They are made up of the role-specific sections at the start of this page (for your type of Account) and the common sections that follow them. Both parts apply together, and together they are called the "Terms". They apply from the moment you accept them, and for as long as you have an Account or use the Platform.
5.2You accept these Terms in either of two ways. The first is by ticking the box or selecting the button that says you agree to them, for example when you sign up or when we ask you to accept a new version. The second is by using the Platform in any way after the Terms have been made available to you. Either one is enough. When you accept, we keep a record of the version you accepted and the date and time of acceptance.
5.3There are three sets of Terms: Student Terms, Agent Terms and Institution Terms. The set that applies to you is the one for the type of Account you hold. If you hold more than one type of Account, each set applies to the Account it is for. The Privacy Policy is a separate document that applies to everyone.
5.4If you do not agree with any part of these Terms, you must not create an Account and you must stop using the Platform. If you have already created an Account, you may ask us to close it as described in the clause on suspension and ending.
5.5If you use the Platform for a business, an agency or an Institution, you confirm that you have the authority to accept these Terms for it, and the business, agency or Institution is bound by them as well as you.
5.6These Terms exist in numbered versions. The version number and effective date are shown at the top of this page. If we publish a new version, the clause on changes to these Terms explains how you will be told and when the new version applies to you.
5.7Other documents may apply to you in addition to these Terms, such as a written agreement between you and StudyInSG, or the rules of an Institution that you apply to. If there is a conflict, a written agreement signed by StudyInSG prevails over these Terms for the matters it covers, and these Terms prevail over any other document that we have not signed.
6. Definitions
6.1In these Terms, the words below have the meanings given to them here. A word that starts with a capital letter and is not listed has its ordinary meaning in the sentence where it appears.
6.2The following definitions apply:
- "StudyInSG", "we", "us" and "our" mean the business that owns and runs the Platform, being [company legal name to be confirmed], and its successors and permitted assigns.
- "you" and "your" mean the person who uses the Platform, and, where you use it on behalf of a business or organization, that business or organization as well.
- "Platform" means the StudyInSG website, the student, agent, institution and administrator portals, the messaging and document tools, and any related service, application or communication that we run under the StudyInSG name.
- "Student" means an individual who uses the Platform to prepare, send or follow an application to study, or who is the subject of an application placed through the Platform by an Agent.
- "Agent" means an education agent, agency or counselor, and any individual who works for one, that has been approved by us to place Students' applications through the Platform.
- "Institution" or "College" means a school, college, polytechnic, university or other education provider that receives applications through the Platform, and the staff who act for it on the Platform.
- "Direct Desk" means the StudyInSG service through which a Student applies directly to us without an Agent, and where StudyInSG staff act for that Student on the Platform.
- "Application" means a request by a Student for a place on a Program, together with the information, forms and messages that belong to it.
- "Application Documents" means the documents and files that support an Application, such as passports, identity documents, academic transcripts, certificates, English test results, references, financial evidence and photographs.
- "Program" means a course, program or place of study offered by an Institution.
- "Personal Data" means data about an individual who can be identified from that data, or from that data together with other information that we or the person holding it have or are likely to have access to, as described in the Personal Data Protection Act 2012 of Singapore (the "PDPA").
- "Consent" means the permission that a Student gives, in the Student's own portal, for the Student's Personal Data to be collected, used and disclosed for stated purposes, including the recorded evidence of that permission.
- "Commission" means any fee, payment, share or other benefit that an Agent or StudyInSG receives from an Institution or from any other person because a Student applies, enrolls or stays enrolled.
- "Account" means the record we create for you on the Platform, and "Login" means the e-mail address, password and any other credential that you use to sign in to that Account.
- "Content" means any information, text, message, file, image, document or other material that you submit to, upload to or create on the Platform.
6.3Headings are for ease of reading only and do not change the meaning of a clause. A reference to a law includes that law as changed or replaced from time to time. The words "including" and "for example" are not limiting.
7. Accounts and security
7.1You must give accurate, complete and current details when you sign up and keep them up to date. If we find that details are false, misleading or out of date, we may ask you to correct them and may limit your Account until you do.
7.2One Login belongs to one person. You must not share your Login, let another person use it, or use another person's Login. If several people in an agency or Institution need access, each person must have a separate Login, and each is responsible for his or her own use.
7.3You must keep your password private and choose one that is hard to guess. You are responsible for all activity under your Login, whether or not you carried it out yourself, unless it happened because of our failure. You must tell us at once if you suspect that your Login has been used without your permission or that your Account has been compromised.
7.4You must not create an Account for another adult, and you must not use the Platform on behalf of another person, unless these Terms allow it for your type of Account.
7.5We may suspend or restrict an Account immediately if we reasonably believe that these Terms have been broken, that the Account is not safe, that false information has been given, or that we must do so to meet a legal duty. Where it is reasonable and lawful to do so, we will tell you why.
8. StudyInSG's role
8.1StudyInSG is an online platform that connects Students, Agents and Institutions so that applications to study in Singapore can be prepared, checked, sent and followed in one place. We also act as a checking and passing-on service between the people who prepare an Application and the Institution that decides it.
8.2We are not a government body, and we are not a visa or immigration authority. We do not issue, approve or refuse visas, student passes or any other immigration permission, and nothing on the Platform should be read as an immigration decision or as immigration advice. Decisions about visas and student passes are made only by the relevant government authorities.
8.3We are not a college, university or other Institution. We do not decide whether a Student is admitted, whether an offer is made, what conditions an offer carries, or what fees an Institution charges. Those decisions are made by the Institution alone, and we have no power to change them.
8.4When an Application passes through us, we check on a reasonable basis that it is complete, that the required Application Documents have been supplied, and that those documents appear genuine. These checks are practical, rule-based and human checks. They are not forensic examinations, they are not a certification that any document is authentic, and they do not remove the responsibility of the Student, the Agent or the Institution for their own part.
8.5We cannot and do not guarantee any outcome. This includes an offer of a place, the terms of an offer, a scholarship, a student pass, the speed of any decision, or the success of a Student's studies or career.
8.6Information on the Platform, including program descriptions, dates and fees that come from Institutions, is provided for general information. You should confirm important details directly with the Institution or the relevant authority before you make a decision that depends on them.
9. Messages and contact rules
9.1Messages about an Application must stay on the Platform. This keeps the conversation in one place, makes it easier to see what was said, and helps protect Students from unsolicited contact.
9.2You must not put e-mail addresses, phone numbers, messaging-app handles or web links in messages on the Platform. A contact guard looks for these and may stop a message from being sent or may remove them. You must not try to avoid the guard by spelling out, splitting or disguising contact details.
9.3Messages are for the purpose of the Application only, such as asking for documents, explaining a requirement, giving an update, or answering a question. They must not be used for advertising, for pressure, or for any purpose unrelated to the Application.
9.4To keep Students and others safe, to meet legal duties, to deal with concerns raised with us and to maintain the quality of the service, StudyInSG may read and retain messages and notes on the Platform. By using messages, you accept this.
9.5We may also send you service messages, such as notices about your Account, about the status of an Application, and about changes to these Terms or the Privacy Policy. These are not marketing messages.
10. Content and acceptable use
10.1You are responsible for your Content. You confirm that you have the right to submit it, that it is accurate, and that it does not break any law or any person's rights.
10.2You must not use the Platform to submit, send or do any of the following:
- content that is unlawful, false, misleading, defamatory, abusive, threatening, harassing, discriminatory, obscene or otherwise harmful;
- any file that contains a virus or other harmful code;
- any attempt to deceive an Institution, an authority, StudyInSG or another user; or
- any use of another person's Personal Data without proper authority or for a purpose other than the one for which it was given.
10.3You must not scrape, copy or harvest data from the Platform; reverse engineer, decompile or try to find the source code of any part of it; use bots, scripts or other automated means to access it; or run security tests, vulnerability scans or penetration tests on it, unless we have given you written permission in advance. If you find a security weakness, please report it to us and do not exploit it.
10.4You must not try to bypass or weaken any check, restriction or security feature of the Platform, including the checklist, the Consent step, the contact guard, access controls and approval steps. You must not access or try to access Accounts, files or data that are not yours.
10.5We may remove or hide Content, and may refuse to pass on an Application, if we reasonably believe that it breaks this clause. We may also report unlawful conduct to the police, to an Institution or to another authority.
11. Service availability and changes
11.1We use reasonable efforts to keep the Platform available and working properly, but we do not promise that it will be uninterrupted, error-free or free from delay. Problems with the internet, with devices, with our service providers and with events outside our control can affect it.
11.2We may change, add, suspend or remove features of the Platform at any time, for example to improve security, to meet legal requirements, or to make the service better. Where a change is large and affects how you use the Platform, we will try to give you notice.
11.3We may carry out planned maintenance and urgent repairs that make the Platform unavailable for a period. We will try to do planned maintenance at times of low use and to give notice of it where practical.
11.4You are responsible for your own devices, internet connection and for keeping copies of anything you cannot afford to lose. Please do not rely on the Platform as the only place where you keep your documents.
12. Privacy and data protection
12.1Our Privacy Policy explains how we collect, use, disclose, store and protect Personal Data. It forms part of these Terms, and it is read together with the PDPA and any other law of Singapore that applies to Personal Data.
12.2Each party must handle Personal Data that it receives through the Platform lawfully, fairly and for the purpose for which it was given. This applies to Agents and Institutions as well as to us. Agents and Institutions are responsible for their own duties under data protection law in respect of the Personal Data they hold.
12.3You must tell us without delay if you become aware of a data breach, or a suspected one, that involves Personal Data obtained through the Platform. We will tell affected people and the Personal Data Protection Commission where the law requires us to, and we expect Agents and Institutions to do the same for the Personal Data they control.
12.4You must not use Personal Data that you see on the Platform for any purpose other than the one that the Student has consented to or that the law permits.
13. Confidentiality
13.1Information that you receive through the Platform and that is not public, such as other people's Personal Data, Application details, internal decisions, commercial terms and security information, is confidential. You must keep it confidential, use it only for the purpose of the Platform and protect it with reasonable care.
13.2This duty does not apply to information that:
- is or becomes public without a breach of these Terms;
- you already lawfully knew, or later receive lawfully from someone who is free to share it; or
- you are required to disclose by law, by a court or by a regulator, in which case you should, where lawful, tell us first and disclose only what is required.
13.3This clause continues after your Account is closed and after these Terms end.
14. Intellectual property
14.1The Platform, including its design, software, text, graphics, logos, trademarks, databases and other material that we provide, belongs to StudyInSG or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of it to you.
14.2We give you a limited, personal, non-exclusive, non-transferable and revocable license to use the Platform for its intended purpose and in line with these Terms for as long as your Account is open. You may not copy, sell, rent, sublicense, modify or build on the Platform or its content except as we allow in writing.
14.3You keep ownership of your own documents and other Content. We do not claim ownership of your passport, certificates, transcripts or other Application Documents.
14.4You give StudyInSG a non-exclusive, worldwide, royalty-free license to store, copy, display, check, process and transmit your Content, to the extent needed to provide and improve the Platform, to carry out your Application, to meet our legal duties and to protect our rights. This license lasts for as long as we hold the Content under the Privacy Policy, and it does not allow us to sell your Content or use it for advertising.
14.5If you give us feedback or suggestions about the Platform, we may use them freely without paying you or naming you.
15. Suspension and ending
15.1We may suspend or close your Account, remove Content, or stop passing on Applications, immediately and without notice if you break these Terms, if we reasonably think that you have given false information or documents, if you put others at risk, if we must do so to meet a legal duty, or if an Agent's or Institution's approval is withdrawn. Where we can reasonably do so, we will tell you why and, where appropriate, give you a chance to put matters right.
15.2We may also close an Account that has not been used for a long time, after giving reasonable notice.
15.3You may close your own Account at any time by contacting us. If you are a Student, you should ask us to withdraw any Applications that are still in progress first, as closing an Account does not cancel anything that an Institution has already received. If you are an Agent or an Institution, you must first finish or hand over the work in progress in a way that does not harm Students.
15.4When an Account is closed, the Platform stops being available to you, but the clauses of these Terms that by their nature should continue to apply, such as those on intellectual property, confidentiality, liability, indemnity and governing law, will continue.
15.5What happens to your data after an Account is closed follows our Privacy Policy, including the periods for which we keep information, the cases in which we must keep it, and your right to ask for access, correction or erasure.
16. Limitation of liability
16.1To the maximum extent allowed by the law of Singapore, StudyInSG is not responsible for loss or damage that results from decisions made by Institutions, Agents or government authorities; from information that users give us that turns out to be false or incomplete; from delay or failure caused by events outside our reasonable control; from your use of the Platform in a way that these Terms do not allow; or from interruptions to the Platform.
16.2To the maximum extent allowed by law, we are not liable for any indirect or consequential loss, or for loss of profit, income, opportunity, data or goodwill, however it arises, even if we were told that it might happen.
16.3To the maximum extent allowed by law, our total liability to you for all claims arising out of or connected with the Platform or these Terms in any twelve-month period is limited to [liability cap to be confirmed].
16.4Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law of Singapore. In particular, nothing excludes or limits our liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our negligence.
16.5Each of these limits is separate and continues to apply even if one of them is found to be unenforceable.
17. Indemnity
17.1To the extent allowed by law, you agree to indemnify StudyInSG, and to keep us indemnified, against losses, damages, costs and expenses (including reasonable legal fees) that we suffer or pay because of your breach of these Terms, your breach of any law, or a claim by a third party that arises from your Content or your conduct on the Platform.
17.2We will tell you promptly of any claim for which we ask for an indemnity and will allow you to take part in dealing with it, as far as that is reasonable. We may take steps to protect our position while you do so.
17.3This clause does not apply to a loss that is caused by our own breach, negligence or willful misconduct.
18. Disputes and concerns
18.1If you are unhappy with the Platform or with something we have done, please tell us first. You can raise a concern by writing to the contact address at the end of these Terms or by using the contact option in the Platform. Please give your name, the e-mail address on your Account, a description of what happened and what you would like us to do.
18.2We will acknowledge a concern promptly and aim to give you a considered answer within 30 days. If we need more time or information, we will tell you why and when you can expect an answer.
18.3If you are not satisfied with our answer, you may ask for it to be reviewed by a more senior person at StudyInSG, who was not involved in the first decision. If the matter is still not settled, the parties will try in good faith to resolve it through mediation before starting court proceedings, unless an urgent court order is needed.
18.4A concern about an Institution's decision, such as a refusal of admission or a refund, should be raised with that Institution under its own process. We will help by passing on information where we properly can.
18.5You can also raise a concern about how Personal Data is handled with the Personal Data Protection Commission of Singapore (the PDPC), as explained in the Privacy Policy.
19. Governing law and jurisdiction
19.1These Terms, and any dispute or claim that arises out of or in connection with them or the Platform, are governed by the laws of Singapore.
19.2The courts of Singapore have exclusive jurisdiction over any such dispute or claim, and each party submits to those courts. This does not stop either party from asking any court for urgent relief, and does not stop us from taking steps to enforce a judgment in another place.
19.3Nothing in these Terms removes any right that you have under a mandatory law, including any consumer protection right that cannot be excluded by agreement.
20. Changes to these Terms
20.1We may change these Terms from time to time, for example to reflect changes in the law, in the Platform or in the way we work. Each new version has a new version number and a new effective date.
20.2We will tell you about a change through a notice in the Platform and, where we hold your e-mail address, by e-mail. For a major change we will give you reasonable notice before it takes effect, except where a change must be made sooner to meet a legal duty or to protect security.
20.3If you keep using the Platform after a new version takes effect, you accept the new version. If you do not agree with it, you must stop using the Platform and may close your Account.
20.4If a change affects your rights in a significant way, for example in how we use your Personal Data or in what you are allowed to do, we will ask you to accept the new version again, and you may be unable to continue until you have done so. The earlier version stays on record for the period in which it applied to you.
21. General
21.1These Terms, together with the Privacy Policy and any written agreement you have signed with StudyInSG, are the whole agreement between you and us about the Platform. They replace earlier discussions and understandings about it.
21.2If any part of these Terms is found to be invalid, illegal or unenforceable, that part will be limited or removed to the smallest extent necessary, and the rest of the Terms will continue.
21.3If we do not enforce a right or a clause straight away, or if we delay in doing so, that does not mean we have given it up. A waiver is effective only if it is given in writing.
21.4You may not transfer your rights or duties under these Terms to anyone else without our written consent. We may transfer ours to a company that takes over all or part of our business, or that acquires the Platform, as long as your rights under these Terms and the Privacy Policy are respected.
21.5We may give you notice by e-mail to the address on your Account or by a notice in the Platform. A notice is treated as received when it is sent or posted. You may give notice to us at the contact details below.
21.6We are not liable for delay or failure to carry out our duties if it is caused by an event beyond our reasonable control, including natural disaster, epidemic, war, terrorism, strike, power or internet failure, failure of a third-party service, or action by a government.
21.7Nobody who is not a party to these Terms has any right to enforce them under the Contracts (Rights of Third Parties) Act 2001 of Singapore, except for a successor or permitted assign of ours.
22. Contact
22.1If you have a question about these Terms, or want to raise a concern, please write to us at [contact e-mail to be confirmed] or by post at [registered business address to be confirmed].
Drafted for review; the final version will be checked by a lawyer before real students use the live site.
